The Strengthening Medicare and Repaying Taxpayers (or SMART) Act is one of the many issues involved in resolving liens associated with personal injury claims.  The SMART act three year deadline for Medicare to assert claims went into affect July 10.  Now, the government cannot take action for recovery of conditional payments unless it is less than 3 years after the date of the receipt of notice of a settlement, judgment, award or other payment by CMS/DHHS.  This puts an end to one of the many complicated issues involved in lien resolution.
