Resident Falls Fifty Times and Dies, Nursing Home Denies Liability
Nursing Home Neglect often takes the form of nursing home falls which are preventable. Typically, someone will be left unsupervised and unattended, and suffer a fall. Falls are basically prevented by having the right assistive devices in place, and having adequate, trained, and responsive staff in close proximity to the resident.
In this nursing home falls case, a resident died after more than fifty falls in the facility. Yes, that is correct, the nursing home, Good Samaritan, allied the resident to fall fifty times, and eventually, the resident died.
Incredibly, in the nursing home’s answer, it denied liability. The nursing home instead asked that “the Court dismiss Plaintiffs’ petition and assess costs against the Plaintiffs, repeatedly, in its Answer to the Plaintiff’s Complaint. (See my posts on Nursing Home Lawsuit Procedure).
